NAME OUR MASCOT CONTEST OFFICIAL RULES

DON’T TRASH NEVADA "NAME THE MASCOT" CONTEST
OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE OF ANY KIND WILL NOT INCREASE YOUR ODDS OF WINNING.

By participating in this Contest, Entrants agree to be bound by these Official Rules and all decisions of Sponsor. All decisions of Sponsor related to this Contest or these Official Rules will be at Sponsor's sole discretion, and all such decisions are final.
1.  Contest Description. Don’t Trash Nevada's "Name The Mascot" contest (the "Contest") is a contest of skill whereby Nevada students may suggest names for the Bighorn Sheep mascot created through the Don’t Trash Nevada program. Don’t Trash Nevada is a litter and dumping prevention program of the Southern Nevada Agency Partnership, managed by the Public Lands Institute at the University of Nevada, Las Vegas. As such, the Contest is designed to capture names for the Bighorn Sheep mascot (“Mascot”) that best represents the mission of the Don’t Trash Nevada program.

2.  ELIGIBILITY: The Contest is open to Nevada residents who are fourteen (14) years old or younger at the time of entry (“Contestant”). Submission of an entry constitutes consent of the Contestant’s parent/legal guardian (“Parent”) to participate in the Contest. Parent on behalf of their eligible child (collectively defined as “Entrant”) shall assume all legal responsibilities of child under these official rules.
Employees of the Public Lands Institute ("PLI" or "Sponsor"), the Bureau of Land Management, National Park Service, U.S. Fish and Wildlife Service, the U.S. Forest Service, the University of Nevada, Las Vegas, their respective advertising and promotion agencies, parents, subsidiaries and joint venture companies, as well as members of their immediate families and households [including children, spouses and siblings and/or persons living in the same households as such persons (whether related or not)] are not eligible to participate in the Contest. All federal, state, and local laws, rules and regulations apply. Void where prohibited.

3.  HOW TO ENTER: The Contest will begin at 10:00 a.m. (P.S.T.) on May 31, 2008, and end at 6:00 p.m. (P.S.T.) on October 15, 2008 ("Contest Period"). To enter, Entrants should direct their internet browser to the Contest registration page at www.donttrashnevada.org/contest, and follow all posted instructions. Entry into the Contest requires completion of personal information forms, the submission of one (1) name suggestion, and a one hundred (100) word or less informative description of the name suggestion (together, a "Submission"). Entries must be made online. Submissions by other methods (such as U.S. mail or telephone) will not be accepted. Submissions must be the sole creation of the Contestant, not the Contestant’s Parent.
The entry form will require Entrants to submit one (1) unique name suggestion for the Mascot. Only one (1) Submission per person or email account.  In the event Sponsor receives more than one Submission from the same Entrant or e-mail account, Sponsor will consider only the first Submission from that source, and shall discard any others.
ANY ENTRY THAT IS ALLEGED TO INFRINGE ON ANY THIRD-PARTY’S INTELLECTUAL PROPERTY RIGHTS, OR THAT SPONSOR DEEMS OBSCENE, OFFENSIVE OR OTHERWISE INAPPROPIRATE FOR VIEWING BY A GENERAL AUIDIENCE, MAY BE DISQUALIFIEDAT SPONSOR’S SOLE DISCRETION.

4.  Judging Criteria and Process: At the close of the Contest Period, well-qualified judges selected by PLI will consider all eligible Submissions, and award up to 100 points to each name suggestion considered. Points for each name suggestion will be awarded using the following criteria: 1) overall suitability of the name suggestion to the theme of the Contest (up to 50 points); 2) originality (up to 20 points); and 3) creativity (up to 20 points); and 4) the accompanying description (up to 10 points). Judging will conclude on or about October 27, 2008.
The five (5) Submissions that receive the highest overall scores (as determined by the sum total of points awarded) will be selected as “Finalists.” From these five Finalists, the one (1) Submission receiving the highest overall score will be deemed the grand prize winner ("Grand Prize Winner"). The remaining four (4) submissions will be deemed “First Prize Winners.” Together, First Prize Winners and the Grand Prize Winner will be referred to as “Winning Entrants.”

SPONSOR IS UNDER NO OBLIGATION TO USE IN ANY WAY ANY NAME SUGGESTION SUBMITTED IN THE CONTEST, REGARDLESS OF SELECTION AS A POTENTIAL PRIZE WINNER. WINNING DOES NOT GUARANTEE USE OF A NAME SUGGESTION. SPONSOR RESERVES THE RIGHT TO NAME THE MASCOT IN ANY WAY, WITHOUT REGARD TO THE CONTEST.

5.  Winner Notification and Verification: The names of the Winning Entrants will be announced on October 27, 2008. Notification will be done via the email address provided on the Winning Entrant's respective entry form.
No prize will be awarded, and no potential Winning Entrant shall have a claim to right, title, or interest in any prize, unless and until the potential Winning Entrant is verified in accordance with these Official Rules. To verify each potential Winning Entrant, PLI will send one (1) email notification. Ten (10) days after notification, any failure to reach winner by email may result in disqualification of the Winning Entrant, forfeiture of his or her interest in all prizes, and selection of a substitute Winning Entrant from among all remaining eligible entries. Entrant is solely responsible to notify Sponsor of any change in Entrant’s contact information.

As a condition of being awarded a prize, Winning Entrants may be required to sign an affidavit of eligibility, a liability and publicity release (except where prohibited by law), and/or any other documents as determined by Sponsor. Any and all such documents required by Sponsor must be completed and returned to Sponsor within ten (10) days of date of personal delivery or date of postmark. Failure to sign and return the affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, may result in a Winning Entrant's disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute Winning Entrant.

Prize Delivery. Prizes may be shipped to the Winning Entrant’s provided address, presented at the Winning Entrant’s school, or delivered in any other method Sponsor deems appropriate.

6.  Prizes and Odds.:
First Prizes.  Each of the four (4) Submissions selected and verified as a First Prize Winner shall receive:
1.  One (1) iPod Nano

The approximate retail value ("ARV") of each Finalist prize is $ 150.00 USD.

Grand Prize. The one (1) selected and verified Grand Prize Winner shall receive:
  1.   One (1) Dell notebook computer.

Total ARV of Grand Prize: $ 750.00 USD.

Odds. As this contest is one of skill, the odds of winning depend upon an Entrant's individual skill level, as well as the skill and number of other competitors.

7.  General Conditions: Prizes are nonassignable and nontransferable, and may not be given, bartered, sold, or exchanged for cash or another prize. Prize may not be upgraded, and no substitutions by winner will be allowed. Sponsor reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of PLI. Winners may waive their right to receive prizes. 
Parent(s) of Winning Entrants are each solely responsible for any and all costs, other than those specifically stated in these Official Rules, that may be incurred or arise as a result of being awarded a prize. Such costs may include, but are not limited to all federal, state, local, or other government or quasi-governmental taxes and fees, and any transportation costs (whether to claim prize or otherwise).

8.  Limitations of Liability: By entering the contest, Entrants agree to release Sponsor, its officers, directors, agents, employees, and all others associated with the development and execution of this Contest from any and all liability with respect to or in any way arising from this Contest and/or acceptance or use/misuse of the prizes, including but not limited to liability for personal injury, bodily injury including wrongful death or disability, damage to property, and damage or loss of any other kind.
Sponsor is not responsible for any incorrect or inaccurate information, whether caused by Web site users or by any of the equipment or programming associated with or used in the Contest or by any technical or human error which may occur in the processing of Submission in the Contest. Sponsor assumes no responsibility for any error; omission; interruption; deletion; defect; delay in operation or transmission; communications-line failure, theft, or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines; computer on-line systems, servers, or providers; computer equipment; software; or failure of e-mail or entry on account of technical problems or traffic congestion on the Internet or at any Web site or combination thereof, including injury or damage to Entrants or to any person's computer related to or resulting from participating or downloading materials in this Web site or Contest. Should any entry be lost as a result of any situation described above, the Entrant's sole remedy is another entry into the Contest, if possible.

Sponsor is not responsible for user cheating or fraud by any Entrants. Any activities intended to disrupt or interfere with the proper play of the Contest, or defraud Sponsor in any way will be prosecuted to the fullest extent of the law. Entrants who engage in any of the foregoing activities will be disqualified and will forfeit any prize won.

If the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right to cancel, terminate, modify or suspend the Contest. Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date.

9.  Copyright/Right of Publicity: By entering the Contest, Entrant irrevocably assigns to Sponsor all rights to publish, print, edit or otherwise use the Entrant's submitted entry, in whole or in part, for any purpose and in any manner or media (including, without limitation, the Internet) throughout the world in perpetuity, and to license others to do so, all without limitation or further compensation. Each Entrant further agrees that if his/her entry is selected by Sponsor as one of the five (5) winning entries, he/she will transfer all right, title, and interest in the submission to Sponsor on an exclusive, royalty-free, and irrevocable basis. This transfer shall be made in writing, and signed by the Winning Entrant’s parent/legal guardian. Finally, Sponsor may require, in its sole discretion, additional license or release forms that Winning Entrant’s parent/legal guardian must sign in order to receive their prizes.
Except where prohibited, participation in the Contest constitutes Entrant's consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without any right of approval or further compensation.

10.  Construction: The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

11.  Disputes: Entrants agree that the laws of the State of Nevada shall govern the validity, construction, interpretation, and effect of this Contest.  Any and all disputes arising out of or in connection with this Contest shall be litigated only in a court of competent jurisdiction in Clark County, State of Nevada, and the Entrants hereby expressly consent to the jurisdiction of said court.

12.  Sponsor: The Name The Mascot Contest is sponsored by the Southern Nevada Agency Partnership, managed by the Public Lands Institute (“PLI” or “Sponsor”) at the University of Nevada, Las Vegas. The decisions of PLI and the Contest judges regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
